1. Scope and provider
1.1 These terms apply to purchases of digital drum kits (WAV files for download) via back2backbeats.com.
1.2 Provider: Back2Back Beats, Vienna, Austria, back2back.officials@gmail.com.
1.3 Beats and beat licenses are sold via the official BeatStars store. The terms shown there and the respective license apply, not these terms.
2. Conclusion of contract
2.1 Showing drum kits on the website is not a binding offer.
2.2 By clicking the purchase button in Stripe Checkout you make a binding offer. The contract is concluded when the purchase is confirmed (confirmation page or confirmation email).
2.3 The contract language is German or English.
3. Prices and payment
3.1 The prices shown in Stripe Checkout apply. VAT information follows the way it is shown there.
3.2 Payment is processed by Stripe (Stripe Payments Europe, Ltd.). The payment terms shown at checkout also apply.
4. Delivery
4.1 Drum kits are delivered digitally only. Nothing is shipped.
4.2 You receive a download link by email after successful payment. The download stays available for as long as technically reasonable. Exact period: to be confirmed.
5. Usage rights
5.1 With your purchase you receive a simple, non-transferable right to use the sounds in your own music productions, including commercially. Scope as shown for the kit at checkout.
5.2 You may not resell, share or publish the sounds as individual samples or as your own sample pack.
6. Right of withdrawal for consumers
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise this right, inform us (Back2Back Beats, Vienna, Austria, back2back.officials@gmail.com) by a clear statement (for example by email). You may use the model form below, but you do not have to. It is enough to send your notice before the period ends.
Effects of withdrawal. If you withdraw, we refund all payments received from you without undue delay and no later than fourteen days after we receive your notice. We use the same means of payment you used, unless expressly agreed otherwise. You will not be charged any fees.
Early expiry for digital content. For contracts for digital content not supplied on a tangible medium, the right of withdrawal expires once we have started performance (making the download available) after you
- (a) expressly agreed that we start performance before the withdrawal period ends,
- (b) acknowledged that you lose your right of withdrawal by giving this consent, and
- (c) received a confirmation of the contract on a durable medium (for example email).
Legal basis: Austria § 18 (1) no. 11 FAGG; Germany § 356 (5) BGB.
Consent at checkout (information). The checkout should collect this consent text from the buyer before the download is provided: "I expressly agree that the download is provided before the withdrawal period ends. I understand that I lose my right of withdrawal as a result." Until this consent is collected at checkout and a contract confirmation is sent by email, the right of withdrawal does not expire early.

7. Warranty
Statutory warranty rights apply (Austria: Consumer Warranty Act, VGG; Germany: §§ 327 et seq. BGB). Please report defects (for example broken or incomplete files) by email with the kit title.
8. Liability
Statutory liability rules apply. Any further limitation of liability is subject to legal review.
9. Privacy
The Privacy Policy applies.
10. Governing law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the country where they habitually reside. Place of jurisdiction: to be confirmed.
